Terms of service

These terms apply when you use peretsdesign.com (the "site") or buy from Perets Design ("Perets Design", "we", "us"), online or in our showroom. By using the site or placing an order, you agree to these terms and to our Privacy Policy, Shipping Policy (which sets out our pickup-only rule) and Refund Policy, which are part of these terms. Nothing in these terms limits rights you have under the Quebec Consumer Protection Act or any other law that can't be waived.
Who can use the site
The site is intended for people in Canada. If you are under the age of majority where you live, use the site with the involvement of a parent or guardian. Children under 14 should not use the site or give us personal information without the consent and supervision of a parent or guardian.
When you place an order, you confirm that you are of the age of majority, or that you are a minor able to make the purchase on your own for your ordinary and usual needs, and that you are authorized to use the payment method you provide.
Your account
If you create an account, keep your login details private. You are responsible for activity on your account. Tell us right away at info@peretsdesign.com if you think someone else is using it.
Products and prices
Prices are in Canadian dollars and don't include taxes, which are shown at checkout. Products are subject to availability, and we may limit quantities.
If a product is listed at the wrong price, or with other wrong information, we will contact you before we release your order and let you choose to buy it at the correct price or cancel your order. If we can't reach you within 10 days, your order will be cancelled and refunded in full to your original payment method.
Photos, sizes and finishes
We try to show our products accurately, but colours may look different on your screen, and dimensions, colours and finishes, such as wood grain or countertop patterns, may vary slightly from the photos and descriptions. Dimensions are listed on each product page. Check them against your space before you order, and come see the products in our showroom if you can.
Sale events and promotions
Sale prices apply while stock lasts. We may change or end a sale at any time, without affecting orders already placed. Items bought at a reduced price are final sale, as explained in our Refund Policy.
Promotions and promo codes have their own conditions, shown with the offer. Unless they say otherwise, they can't be combined, have no cash value, and can be changed or ended at any time without affecting orders already placed.
Orders and payment
Your order is an offer to buy. The order confirmation email confirms that we received it. We accept your order when we email you that it is ready for pickup. Online, your payment is taken at checkout.
We may refuse or cancel an order, including after payment, if a product is unavailable, if there is a pricing error, or if we have reason to believe the order is fraudulent or misuses our policies, including attempts to get around payment or to exploit promotions to receive items for free. If we cancel, you get a full refund to your original payment method.
Buying in the showroom
You can also buy in our showroom. You can pay on your own phone through our website, through a payment link or draft order we send you, or with cash or a credit card. These terms apply to showroom purchases too.
Accurate information
Please give us accurate, complete contact details, so we can tell you when your order is ready and reach you if there is a problem with it.
Electronic communications
You agree to receive order confirmations, pickup notices and other information about your orders and account by email or on our site. These count as written notice. They are separate from marketing messages, which you receive only if you subscribed.
Pickup only
We don't ship or deliver. Every order is picked up at our showroom, 1881, boulevard Saint-Régis, Dollard-des-Ormeaux, Quebec H9B 2M9. Pickup hours and details are in our Shipping Policy.
- Your order is ready when we email you. Please wait for that email before you come.
- We hold your order for 14 days after that email. If you need longer, contact us before the 14 days are up. If your order isn't picked up within 14 days, we'll contact you. If it still isn't picked up 30 days after that email and we can't reach you, we cancel it and refund you in full to your original payment method.
- Bring your order confirmation and photo ID matching the name on the order. For online orders, we may also ask to see the card used to pay. If someone else is picking up for you, tell us their name in advance; they'll need to show their own photo ID.
- Our team will help you load your order into your vehicle. Please bring a vehicle large enough for the carton.
Ownership and risk of loss pass to you when you pick up your order.
Inspect your order at pickup
Inspect your order at pickup. If an item is damaged or not what you ordered, follow the steps in our Refund Policy.
Installation
Installation is not included, and we don't install products. Installation is your responsibility. Our Refund Policy accepts returns only for uninstalled items, so check the fit and measurements before you install.
Returns and exchanges
Returns, exchanges and refunds follow our Refund Policy. In short: regular-priced items can be returned within 10 days of pickup, under the conditions in that policy; items bought at a reduced price, during a sale event or with a coupon or discount code are final sale. Damaged or incorrect items are handled as that policy describes. This doesn't limit your legal warranties under the Quebec Consumer Protection Act.
Our content
Everything on the site, including our name, logos, designs, photos and text, belongs to Perets Design or our licensors. You may use the site for your own personal shopping. You may not copy, reproduce or use our content for commercial purposes without our written permission.
Your submissions
If you send us comments, ideas, reviews, photos or other content, you confirm that you have the right to share it, and you allow us to use, reproduce and publish it in connection with our business, without payment. We won't publish your full name without your permission.
Acceptable use
Don't use the site to break the law, interfere with the site or its security, scrape or harvest data, place orders for resale or with false information, or misuse our promotions.
Third-party services and links
Some services on our site are provided by others, such as Shop Pay, PayPal and other payment options, and our live chat. They have their own terms and privacy policies. Our site also links to other sites and social networks that we don't control, and we're not responsible for their content or practices.
Ending access
We may suspend or end your access to the site or your account, without notice, if you break these terms, commit fraud or misuse our promotions. If you're a consumer in Quebec, we will tell you why. Sections that by their nature should continue, such as those on liability and governing law, still apply after access ends.
Liability
We provide the site as it is and do our best to keep it accurate and available, but we can't promise it will always be error-free or uninterrupted. To the extent the law allows, Perets Design is not liable for indirect or consequential damages arising from your use of the site. Our products come with the legal warranties provided by the Quebec Consumer Protection Act, and nothing in these terms excludes them or our liability for our own acts or those of our representatives.
Events outside our control
We're not responsible for delays or failures caused by events we can't reasonably control, such as supplier delays, severe weather, strikes, power or internet outages, or public health measures.
Governing law and disputes
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. If you are a consumer, you may bring a claim before the courts of your place of residence. If you have a concern, please contact us first at info@peretsdesign.com so we can try to resolve it informally. This doesn't limit your right to go to court.
Other terms
If a court finds part of these terms invalid, the rest still applies. If we don't enforce a part of these terms right away, we can still enforce it later. These terms, together with the policies they refer to, are the full agreement between you and us about the site and your purchases.
Language
These terms are available in French and English. You can switch languages using the language selector on our site.
Changes to these terms
We may update these terms. The version that applies to your order is the one posted when you placed it. When we make important changes, we change the date at the top of this page and give at least 30 days' notice on our site or by email before they take effect.
